YDN Radio Brighton - Pay-per-view Terms and Conditions

These terms and conditions ("Pay-per-view Terms and Conditions") shall apply to Your use of the Pay-per-view Areas on the YDN website.

By purchasing and using the Pay-per-view service you agree to be bound by the Pay-per-view Terms and Conditions which shall form a legal agreement between Us and You.

If You do not agree to be bound by the Pay-per-view Terms and Conditions, You may not use the Pay-per-view service.

Where these Pay-per-view Terms and Conditions are inconsistent with the Website Terms and Conditions these Pay-per-view Terms and Conditions shall prevail.

Pay-per-view payments for events/show are processed by FBC Business a Simifran (UK) Ltd Company.

The Service
a) To purchase an Event you must be aged 18 or over, have a valid residential address, a broadband connection and a Device, and accept these Terms.
b) You must follow our reasonable instructions and requirements in relation to how you use the Service, as set out in these Terms and on the Website and updated by us from time to time. It is your responsibility to regularly check the Website for updates to such instructions and requirements.
c) Events are purchased on a 'pay per view' basis via the Website. Access to an Event begins at the advertised start time on the Website (or any other time that we may notify you of in accordance with these Terms).
d) You will be charged for an Event at the point you purchase it via the Website. When you confirm your transaction and, unless we agree otherwise, you acknowledge that once the Event begins you cannot cancel your order after this point, as this is the point at which we begin supply of the Service.
e) Events may be rescheduled or cancelled or withdrawn at any time. If an Event you have purchased is rescheduled, cancelled or withdrawn, we will advertise the change or cancellation on the Website and endeavour to notify you via email.
f) To view an Event on a Device, it must be connected to broadband with a minimum broadband connection of at least 800 kbps. The ability to stream an Event may be impacted by the speed of your internet connection and may be unavailable with internet connections below certain speeds. We are not responsible for your internet service and you should contact your provider if you experience problems with it. Content streamed to a Device will count towards any broadband usage limits that apply to your broadband service. You are responsible for any charges associated with exceeding those limits.
g) The Service is provided for your non-exclusive and non-commercial use. You must not purchase or stream Events outside of the approved Territories. Unless we agree otherwise, Content you rent or purchase cannot be transferred to another account.
h) You're responsible for the security and proper use of your password and the access to and activities (including purchases) on your account. We will not be liable for any loss caused as a result of you failing to take proper care of your log-in details and password. If you know or suspect that your password has been compromised, or you suspect or become aware of any other breach of security, you must tell us immediately, and you must also ensure that any such password is changed as soon as possible. If we believe that there's been, or is likely to be, a breach of security we may suspend passwords and require that they're changed and restrict your rights to use all of or any part of the Service.
(i) You must not access or use the Service for any improper or unlawful purpose and you will not allow anyone else to do the same.

Event Purchase. means where You are to pay to Us the Purchase Fee in advance for a Pay-per-view event to view each of the events

You are not permitted to send any content from the Subscription Areas to other users. You acknowledge that the Video Content is owned by or licensed to Us and Your rights to such content shall be limited to the viewing for private use in accordance with the Subscription Package You have paid for.

When accessing and using the Subscription Areas You shall comply with all applicable laws and regulations in the country from which You access the Subscription Areas.

Price and Payment
a) All our prices are set out within the Service and may change from time to time. Our prices include VAT (where applicable) and any applicable sales tax. You pay the quoted price whatever the applicable rate of VAT. We're not obliged to honour prices that are the result of obvious errors and which you could reasonably be expected to know are mis-pricing. Your legal rights aren't affected.
b) Your Pay-pal account or payment card will be charged the full price for the Event when you order and purchase an event.
c) Under this Agreement, the payment processing services for the PPV Service will be provided by Pay-pal via the FBC Business account. FBC Business is a Simifran (UK) Ltd company, depending on the type of payment method used for the purchase of the Service. During the purchase process, you'll need to provide Pay-Pal with the information needed to collect payment. You authorise FBC Business via their Pay-pal account to collect payments on our behalf and when FBC Business is not able to process a payment, you will not be able to purchase or view an Event to which the failed payment relates.
d) If a processing error is discovered which relates to payment, we will rectify the error. If the error resulted in the non-completion of a transaction on time or in the correct amount, we will be liable for your losses or damages directly and reasonably foreseeably caused by this failure, unless:
(i) Through no fault of Pay-pal, you did not have enough available funds to complete the transaction or your issuing bank declined or rejected the payment for a variety of other reasons such as but not limited to; a lost or stolen card, a general decline or an invalid account.
(ii) Our system was not working properly and you knew about the breakdown when you started the transaction; or
(iii) Circumstances beyond our control (such as fire or flood or loss of internet connection) prevented the transaction despite our reasonable precautions.
e) Further to section (d) above, if a processing error is discovered, we shall not be liable for any financial loss, loss of information, damage to (or corruption of) data or any indirect loss or damage of any kind, whether caused by tort (including negligence) or breach of contract.

Refunds

All Single-Event Live Pay-Per-View tickets, and all Recorded Content ticket sales are final. No refunds shall be given unless there is a stream outage of greater than 10 consecutive minutes during the live event or recording.

 Warranties: YDN makes no warranties of any kind, whether expressed or implied, for the service it is providing. YDN also disclaims any warranty, express or implied, of merchantability or fitness for a particular purpose. YDN will not be responsible for any damage suffered. This includes loss of data resulting from delays, non deliveries, mis deliveries, or service interruptions caused by YDN's negligence or the subscriber's errors or omissions. Use of any information obtained via YDN is at your own risk. YDN specifically denies any responsibility for the accuracy or quality of information obtained through its services.

Interruption of Service:
You hereby acknowledge and agree that YDN will not be liable for any temporary delay, outages or interruptions of the Services. Further, YDN shall not be liable for any delay or failure to perform its obligations under this Agreement, where such delay or failure results from any act of God or other cause beyond its reasonable control (including, without limitation, any mechanical, electronic, communications or third-party supplier failure).
